TERMS AND CONDITIONS OF PURCHASE

 

The purchases made by users via our website www.biostep.es are governed by the terms and conditions described below. The purchase of products through www.biostep.es  implies the acceptance in full and without reservation by the user of the following terms and conditions of purchase. These Terms do not cover Products sold by third parties outside the Website.

  1. Product information and offer modifications

 

BIOSTEP may modify at any moment the terms and offers published on its website (prices, products, promotions and other business terms or terms of service), but in any case, the modifications shall not affect past purchases made by our users.

 

The names and brands of the products and manufacturers are used solely for identification purposes.

 

Special offers, promotions or discounts shall be valid until the indicated date or until the specified supplies last, as shall the prices displayed at the moment a user consults the webpage.

 

 

  1. How can I make purchases on the website?

 

 

Users can complete a purchase of our products by following the purchase procedure described in this section. By purchasing our products, users accept that communication with BIOSTEP shall happen mainly through electronic means.

 

To proceed with an ordinary purchase on our website, you must simply follow the steps indicated on the website itself. So, once you have filled the shopping cart with all the products that you wish to purchase, you can modify or complete the purchase, filling out the information required for this purpose and proceeding to pay the amount for the products purchased through the corresponding payment methods.

 

After choosing the payment method, if the user wishes to pay by card (Redsys) or PayPal, the user shall have access to a payment gateway in which he will have to include his credit card or PayPal information. This data will be transferred in a secure manner and through encryption protocols that prevent their capture by third parties. Under no circumstances will the user’s banking data be stored in the servers and databases of www.biostep.es.

 

Following the above steps, the purchase shall be considered complete and the user shall receive by email a confirmation of his order, which must reflect in detail the products that the user has purchased and the terms and conditions of the purchase. Through this confirmation, the user shall be provided with an order number.

 

 

 

  1. Price of the products. Taxes and customs

 

Price of the products and taxes

 

The price that is displayed at any moment next to our products includes any added taxes (Spanish VAT) and shipping costs.

 

If there is a typographical error in the displayed prices and if the user has made a purchasing decision based on said error, we will inform you of this incident immediately and the user will have the right to cancel the purchase at no cost on his part.

 

 

For deliveries to the Canary Islands:

 

At the moment the Canary Islands are not available as a destination country to our shipping services.

 

For deliveries to other European Countries:

 

In the event that the website performs sales to European countries where different VAT rates may apply, (examples of European countries where different VAT rates may apply and for which it is possible to include a delivery address; Austria, Belgium, Bulgaria, Croatia, Republic of Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia and Sweden, without prejudice to the possibility of this list being expanded at a later date) in these cases the tax to be applied would be that of the country of origin (in our case, the Spanish VAT that is already included in the prices of the products) until the volume of sales of the company, with the country of destination of the purchase, exceeds the thresholds established by each country. From then on, we ensure that our system recalculates the prices and sales made to these countries so that they are subject to the VAT of the destination country (the country to which your purchase will be sent as a customer).

CUSTOMS

 

It is important to know that the Canary Islands, although they are part of Spain, have their distinct fiscal regime. This transforms them into a third country and thus the entry or exit of goods from the Canary Islands generates some custom duties.

 

            IMPORTANT: The potential custom duties that may be generated in the event of sales to the Canary Islands and/or other destination countries that are considered third countries, shall not be borne by BIOSTEP.

 

 

  1. What are the terms of shipping and transportation?

 

            4.a) Where do we deliver?

 

We deliver to the Balearic Islands and within the peninsula.

 

We also deliver to the following countries; , Belgium, Bulgaria, Croatia, Republic of Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia and Sweden; without prejudice to the fact that this list may be expanded in the future.

 

            4.b) When will you receive your order? 

 

All our orders will be sent through the transportation company GENEI.

 

The delivery time is:

 

– Peninsula 1 working days.

 

– Europe 7 working days.

 

If there are delivery delays for reasons not imputable to BIOSTEP, the client will be notified promptly after BIOSTEP becomes aware of the delay. The agreed product delivery deadlines are without prejudice to delays that may be caused by events of force majeure.

 

 

            4.c) How should I proceed in the event of delays or errors in shipping or delivery? 

 

In the event of delivery delays or errors or lost products, please contact BIOSTEP (as soon as possible) by phone at +34 965 435 300 and/or at the email address info@biostep.es and BIOSTEP will get in touch with the logistics company to begin an investigation and resolve the incident quickly. We will make every effort within our reach, for as long as necessary, to contact the user as soon as possible and provide him with the best possible solution or, if the user so indicates, to send him a new identical package at no cost.

 

The user will have the right to terminate the contract and be refunded the amount paid for the product and shipping if we do not perform the delivery within the agreed deadline and if the conditions set forth in article 66bis of Royal Legislative Decree 1/2007 of 16 November, that approves the revised text of the General Law for the Protection of Costumers and Users and other supplementary laws, are met.

 

 

            4.d) What are the shipping costs?

 

 

The shipping costs are indicated separately at the moment an order is made and are paid by the user who must accept them before proceeding with the payment.

            4.e) Where will I receive the order?

 

The products will be delivered to the address that the user indicates in the order form.

 

 

The delivery will be made by the transportation companies offered by BIOSTEP.

 

 

If the user is absent at the moment the order is delivered, the transportation company will contact you so you can agree to a new delivery. BIOSTEP will follow up on the delivery of the order.

 

 

  1. Payment methods

 

 

            5.a) What payment methods can I use?

 

 

You can pay for the products by bank transfer, credit card or through the payment platforms Redsys and PayPal.

 

 

            5.b) Is the credit card payment system secure?

 

 

This system is entirely confidential and secure and the data cannot be seen by third parties. BIOSTEP does not store information regarding the payments made by users. The information will be provided directly to the payment platform by the banking institution.

 

 

  1. How will I be invoiced?

 

 

The user accepts that the invoices for the purchase of products will be issued in electronic format and will be sent by email. If you do not receive an invoice, you can request one at the email address info@biostep.es. If you are unable to receive emails, the user may request a paper copy of the invoice by calling the number +34 965 435 300.

 

 

 

  1. Changing sizes and returns (Right of withdrawal).

 

 

            7.a) Changing sizes.

 

            If there is an error in the size of the product, the User must notify BIOSTEP, either by mail sent to PEDRO INIESTA, SA (BIOSTEP) at the following address: C/ Arnedo, nº 3, C.P. 03.206- Polígono de Carrús- Elche (Alicante) – SPAIN or by email to info@biostep.es within 2 days from the day when the user received the article, indicating all the characteristics of the article and the new size in which you wish to receive the exchanged article.

 

Once BIOSTEP has received the request, it will get in touch with the user to indicate the steps to be undertaken to perform this exchange.

 

 

The user must prepare the package to be returned in its original box, which must also include any accessories that were sent with the original order (labels, manuals, documentation, gifts, etc.) together with the original packaging in perfect state (including adhesives, buffers, etc.). The user must mail the item, using their preferred mail carrier, at their expense, to PEDRO INIESTA, SA (BIOSTEP) at the following address: C/ Arnedo, nº 3, C.P. 03.206- Polígono de Carrús- Elche (Alicante) – SPAIN.

 

 

 

Once the order has been received, BIOSTEP will inspect the article(s) thoroughly and if the change is accepted, an e-mail will be sent to the user for this purpose, or if not, an e-mail will also be sent to the user indicating the reasons why the return was not accepted.

 

If any of these conditions is not met, BIOSTEP will get in touch with the user to offer him the option to return the articles that have not been accepted. All the expenses generated by this return, including the transportation of the articles, will be borne by the user.

 

 

Otherwise, BIOSTEP will proceed with the exchange of the product, and in this case the shipping costs will be free.

 

 

Only size exchanges will be accepted, and for this reason, one article cannot be exchanged for another, different article. In this case the user must begin the return process for said article and start a new purchase.

 

 

The size of a chosen article can be changed only and if the desired size is available.

 

 

 

            7.b) Returns. Right of Withdrawal.

 

 

            1º) How long do I have to withdraw from my purchase or decide to return a product?

 

 

The User will have fourteen calendar days to decide to return the “Product” from the date they receive it without incurring any fees or expenses, except for the return shipping costs, and without needing to provide a justification.

 

 

The withdrawal period shall expire 14 calendar days from the day on which the user or an authorised third party receives the product.

 

 

 

            2º) How can I withdraw from the purchase?

 

 

If you wish to return the product or withdraw from the purchase, you must notify us of your decision to withdraw from the contract through a clear statement sent by mail to PEDRO INIESTA, SA (BIOSTEP) at the following address: C/ Arnedo, nº 3, C.P. 03.206- Polígono de Carrús- Elche (Alicante) – SPAIN or by email to info@biostep.es.

 

 

You may use the sample withdrawal form that we include below, although its use is not obligatory, and any communication in which you inform us of your decision to exercise the right of withdrawal before the corresponding deadline will suffice.

            3º) What are the terms for exercising the right of withdrawal?

 

 

The User, without needing to provide justification and without incurring any fees, may, within fourteen calendar days following the reception of the order, exercise its right of WITHDRAWAL, and may, for this purpose, return the product(s) purchased on www.biostep.es,  by mail to PEDRO INIESTA, SA (BIOSTEP) at the following address: C/ Arnedo, nº 3, C.P. 03.206- Polígono de Carrús- Elche (Alicante) – SPAIN.

 

 

In the event of withdrawal on your part, BIOSTEP will return all payments received, including shipping fees (if any). However, you must return or deliver the products directly, without any undue delay and, in any case, no later than 14 calendar days from the date on which you informed us of your decision to withdraw.

 

 

The returns must happen through Gesei, and the delivery costs for the return (return from the user’s address to that of the seller) will be borne by BIOSTEP, and for this purpose BIOSTEP will get in touch with the client to agree on, with the transportation agency, a date and hour to pick up the order to be returned at the address indicated in the order form.

 

 

            4º)  How will I be reimbursed?

 

 

Once the right of withdrawal has been exercised using the aforementioned steps, BIOSTEP will contact the user, offering him a product exchange, a gift voucher, a discount voucher, etc. Notwithstanding the above, if the user wishes to return the product(s) that form part of his order, BIOSTEP will indicate all the steps to be followed for the return.

 

 

The user must prepare the package to be returned, if possible, in the original pouch or box, or in this latter’s absence in a packaging that protects appropriately the product(s) to be returned. Said package must also include any accessories that have been sent with the original order (gifts, manuals, documentation, labels, etc.) in addition to the withdrawal form, fully completed. The package must be sent via postal service, the shipping costs of said return being at the expense of BIOSTEP, to the following address: PEDRO INIESTA, SA (BIOSTEP), C/ Arnedo, nº 3, C.P. 03.206- Polígono de Carrús- Elche (Alicante) – SPAIN

 

 

 

 

Once the returned products have been received, BIOSTEP will inspect the item(s) thoroughly. If the return is accepted, BIOSTEP shall send an email to that effect, or, otherwise, the user will also receive an email indicating the reasons for non-acceptance.

 

 

 

If any of these conditions are not met, BIOSTEP will contact the user to offer him the option to return the items that have not been accepted. All the expenses generated by this return, including the transportation of these articles, will be paid by the user.

 

 

 

Otherwise, BIOSTEP will refund the amount paid for the products, using the same payment method employed by the user during the purchase and in all cases, the users shall not incur any fees as a result of any refunds made within a maximum period of 14 calendar days from the date on which we are informed of the withdrawal.

 

 

In the event that the order has not been delivered, we may withhold the refund until we have received the products, or until you provide proof of the return of the products. When returning a “Product”, we recommend that you obtain proof of delivery.

 

 

In accordance with section e) of Article 103 of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Protection of Consumers and Users and other supplementary laws, the right of withdrawal shall not apply to articles manufactured to order or made to measure.

 

 

  1. Legal Guarantee

 

 

The products sold by BIOSTEP are covered by a legal guarantee of 2 years from the delivery of the new products, at the expense of the seller, in accordance with the regulations concerning consumers and users. Nevertheless, since BIOSTEP also sells products with a life span of less than these 2 years, the guarantees will apply taking into account the nature of the goods offered.

 

 

In the event that the product purchased is defective, the user may exercise his right to demand from BIOSTEP, as appropriate, the replacement, repair, price reduction of the product or termination of the contract with the consequent refund of the full amount of the price of the article and shipping costs. These steps will be free of charge for the customer.

 

 

The consumer and user must inform the seller of the non-conformity within two months from the moment it becomes aware of said non-conformity.

 

For the return to be accepted by BIOSTEP, the product must be returned in perfect condition, and must not have been used beyond the mere verification of its good condition and operation, it must not have suffered any damage from improper use, and must be in the same condition as it was delivered: preserving both its original box and all its initial contents (accessories or promotional material), preserving the original packaging, and in the event that the product is not returned in its original package (preserving adhesives, buffers and/or other elements it contained), the good will suffer a depreciation.

 

 

If any of the requirements listed above are not fulfilled, it will be understood that the product will be depreciated accordingly for the following items:

 

Shipping box: 3€

 

Any other element included in the box: 5€

 

Orders that have benefited from a multiple purchase promotion of the 2×1 type or a gift item must be returned in full to receive a refund.

 

 

Once any return has been rejected, the customer will have 3 months to collect and/or withdraw their order from the central facilities, incurring the costs of the collection. If in 3 months the order has not been picked up, said package will be sended to charity.

 

 

 

We do not cover defects caused by misuse, negligence or incorrect manipulation. The “Products” sold on our Website are destined only for the use described in the specifications of each product.

  1. Force Majeure

 

 

BIOSTEP will not be liable for any failure or delay in the performance of any of the obligations it has undertaken, where such failure or delay is due to events beyond our reasonable control (“Force Majeure”).

 

Force Majeure shall include any act, event, failure to exercise, omission or accident which is beyond our reasonable control such as a) Strikes, lockouts or other industrial actions; b) Civil commotions, riots, invasions, terrorist threats or attacks, war (whether declared or not) or threat or preparations for war; c) Fires, explosions, storms, floods, earthquakes, collapses, epidemics or any other natural disasters; d) Impossibility to use means of transport; Impossibility to use telecommunications systems; and e) Government acts, regulations or restrictions.

 

The obligations derived from these terms and conditions shall remain suspended for the duration of the event of Force Majeure and the period for fulfilling these obligations shall be extended for a period equal to the duration of the event of Force Majeure and we shall use all reasonable means to terminate the event of Force Majeure or find a solution to enable us to fulfil our obligations notwithstanding the event of Force Majeure.

 

 

 

 

 

 

 

  1. Partial invalidity

 

If any of these terms and conditions is declared null and void by a final decision of the competent authority, the remaining terms and conditions shall remain in force, without being affected by such declaration of invalidity.

 

 

  1. Applicable legislation and competent courts

 

The contracts for the purchase of Products through our Website and the claims or requests that are derived from the same or that refer to its object or performance (including disputes or non-contractual obligations) shall be governed by Spanish law.

 

Any dispute arising out of or in connection with the use of the website or such products shall be subject to the non-exclusive jurisdiction of the competent Spanish Courts and Tribunals of Elche (Alicante) or those having jurisdiction because of the matter in question.

 

 

If you are contracting as a consumer, nothing in this clause will affect your rights under current legislation, and you may choose to file a complaint to assert your rights in relation to these terms and conditions before the judge or courts corresponding to your residence.
